CPG HomeHub Terms of Use for CENTUM and C21 Agents

1. Acceptance of Terms

The Platform is operated by CPG HomeHub Limited Partnership (“CPG HomeHub”), a member of the Charlwood Pacific Group, which includes CENTURY 21 Canada Limited Partnership and CENTUM Financial Group Inc.

By accessing or using this website and/or mobile application (the “Platform”), you (“User” or “you”) agree to be bound by these Terms of Use (“Terms”) as set forth by CPG HomeHub Limited Partnership (“CPG HomeHub”), a member of the Charlwood Pacific Group. If you do not agree to these Terms, do not use the Platform.

2. Purpose of the Platform

The Platform is provided for the purpose of administering real estate transactions, including but not limited to property listings, communications, document management, and related services. By using the Platform, you consent to the use of your information for these purposes. The Platform is intended exclusively for use by authorized agents of CENTURY 21 Canada Limited Partnership and CENTUM Financial Group Inc., and is not available for use by the general public.

3. Eligibility

You must be at least the age of majority in your province or territory of residence to use the Platform. By using the Platform, you represent and warrant that you meet this requirement. In addition to meeting the age requirement, you must be a registered agent affiliated with CENTURY 21 Canada Limited Partnership or CENTUM Financial Group Inc. to access and use the Platform.

4. User Account and Security

You may be required to create an account to access certain features of the Platform. You agree to provide accurate, current, and complete information and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Collection and Use of Personal Information

By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy and in accordance with applicable Canadian privacy laws. You acknowledge that your personal information may be used to facilitate real estate transactions and related communications.

6. User Conduct

You agree not to use the Platform for any unlawful or prohibited purpose. You further agree not to:

• Impersonate any person or entity;
• Misrepresent your affiliation with any person or entity;
• Interfere with or disrupt the operation of the Platform;
• Upload or transmit any viruses or malicious code;
• Use the Platform to transmit unsolicited communications.

7. Intellectual Property

All content, trademarks, logos, and other intellectual property on the Platform are the property of the Platform operator or its licensors. You may not reproduce, distribute, or create derivative works from any content on the Platform without express written permission.

8. Third-Party Services

The Platform may contain links to third-party websites or services. The Platform operator is not responsible for the content or privacy practices of such third parties.

9. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied. The Platform operator does not warrant that the Platform will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by applicable law, the Platform operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Platform.

11. Indemnification

You agree to indemnify and hold harmless the Platform operator and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Platform or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province or Territory in Canada in which you reside, and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in your province or territory of residence.

13. Changes to Terms

The Platform operator reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform constitutes your acceptance of the revised Terms.
